What Is Public Adjuster?

A public adjuster is the one adjuster in a claim who works for the policyholder. Carrier staff adjusters and independent adjusters both represent the insurance company; a public adjuster is retained by the property owner to document the loss, prepare the estimate, and negotiate the settlement. In Texas, public adjusters are licensed by the Texas Department of Insurance, their fee is capped by statute at 10 percent of the insurance settlement, and the roles are deliberately separated: Texas law prohibits a roofing contractor from acting as an adjuster or advertising to adjust claims on a roof it is contracted to repair, and a public adjuster cannot take a financial interest in the repair work. Public adjusters make economic sense mainly on large, complex, or disputed losses, where documentation depth changes the outcome; on a straightforward approved roof claim, the fee reduces the recovery without changing the scope much.

Important Distinction

Note: A public adjuster is not a roofing contractor and a roofing contractor is not a public adjuster: in Texas a contractor may not negotiate or adjust the claim, and a public adjuster may not also contract for the repairs on the same loss.
